Please read these Terms and Conditions (“Terms”) carefully before using the services offered by Glam Health (“Company,” “we,” “us,” or “our”). By accessing or using our platform, website, or any associated services, you (“Patient,” “Member,” or “you”) agree to be bound by these Terms. If you do not agree, you may not use our services.
1. Overview of Services
Glam Health is a telehealth platform that connects patients with licensed healthcare providers for the evaluation, prescription, and ongoing management of FDA-approved and compounded weight loss medications, including but not limited to Semaglutide and Tirzepatide.
Our services include:
- Online intake and health history collection
- Asynchronous or synchronous telehealth consultations with licensed providers
- Prescription issuance (where clinically appropriate)
- Coordination with licensed compounding pharmacies for medication fulfillment
- Ongoing check-ins and care team support
We do not provide emergency medical services. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.
2. Eligibility
To use our services, you must:
- Be at least 18 years of age
- Reside in a U.S. state in which we are authorized to provide telehealth services
- Provide accurate, complete, and current health and personal information during intake
- Not be pregnant, breastfeeding, or planning to become pregnant unless disclosed and cleared by your provider
We reserve the right to decline services to any individual who does not meet our clinical eligibility criteria. Eligibility is determined solely by our licensed providers.
3. Consultations and Prescriptions
All treatment decisions, including whether to issue a prescription, are made exclusively by licensed, independent healthcare providers. We do not guarantee that a prescription will be issued following a consultation.
Your provider may decline to prescribe medication if:
- Your health history indicates a contraindication
- Requested information is incomplete or inaccurate
- Your BMI or clinical presentation does not meet prescribing guidelines
- Any other clinical reason as determined by the provider
Providers practicing on our platform are independent contractors, not employees of the Company. Glam Health does not practice medicine and does not interfere with the clinical judgment of any provider.
4. Medications
4.1 Compounded Medications
Medications dispensed through our pharmacy partners may include compounded formulations of Semaglutide or Tirzepatide. Compounded medications are prepared by state-licensed 503A or 503B compounding pharmacies. Compounded drugs are not FDA-approved and have not been evaluated by the FDA for safety, efficacy, or quality.
4.2 No Returns or Refunds on Medications
All dispensed medications are non-returnable and non-refundable once shipped, regardless of whether they have been used. This policy exists to protect patient safety and comply with pharmacy regulations.
4.3 Storage and Use
You are responsible for properly storing and administering your medication in accordance with the instructions provided by your provider and pharmacy. Do not share your medication with others.
5. Refund Policy
Our refund policy is as follows:
- If our clinical team determines you do not qualify for weight loss medication following your provider consultation, you are eligible for a refund of your plan payment, minus a 50 consultation fee.
- The 50 consultation fee is non-refundable under all circumstances, including disqualification.
- No refunds will be issued once medication has been dispensed or shipped.
- Refunds are not available based on dissatisfaction with results, side effects, or a decision to discontinue treatment after medication has been issued.
- Lab work fees, if applicable, are billed separately and are non-refundable.
Eligible refunds will be returned to your original payment method within 5–10 business days of determination.
6. Patient Responsibilities
By enrolling in our program, you agree to:
- Provide accurate, complete, and current medical and personal information at all times
- Disclose all current medications, supplements, allergies, and medical conditions
- Promptly notify your care team of any changes in your health status or any adverse reactions to medication
- Follow your prescribed treatment plan and attend scheduled check-ins
- Not use our services as a substitute for emergency care or in-person medical treatment when necessary
- Maintain a current, valid payment method on file
7. Privacy and Health Information
We take your privacy seriously. Your protected health information (PHI) is handled in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and our Privacy Policy, which is incorporated into these Terms by reference.
By using our services, you consent to the collection, use, and disclosure of your health information as described in our Privacy Policy, including sharing necessary information with licensed providers and pharmacy partners for the purpose of delivering care.
8. Payments and Billing
All plan fees are billed upfront at the time of purchase. Prices reflect the per-month average for the selected plan term. By purchasing a plan, you authorize us to charge your payment method for the full plan amount.
We do not accept insurance currently. Our services are offered on a direct-pay basis.
We reserve the right to update pricing at any time. Changes will not affect your current active plan.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Glam Health and its affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use our services.
Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you to us in the three (3) months preceding the claim.
10. Disclaimers
Glam Health does not guarantee specific weight loss results. Individual outcomes vary based on adherence to treatment, lifestyle factors, and individual health conditions.
Our platform and content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.
11. Termination of Services
We reserve the right to suspend or terminate your access to our services at any time, with or without notice, if we determine that you have violated these Terms, provided false information, or if continued service would pose a safety risk.
You may discontinue use of our services at any time by contacting our support team. Discontinuation does not entitle you to a refund unless you meet the criteria set forth in Section 5 above.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Texas.
13. Changes to These Terms
We reserve the right to update or modify these Terms at any time. We will notify you of material changes via email or a prominent notice on our platform. Your continued use of our services after such notice constitutes your acceptance of the updated Terms.
